my battle eye is saying that I have not accepted the terms and when I try to it doesn't give me the option to and so can't accept and it says that I closed the app in a usual manner and doesn't allow me to fix it

Please contact BattlEye directly for any BattlEye related issues at Battleye.com/support.
You can also try to delete the BattlEye folder from your DayZ client and C:\Program Files (x86)\Common Files\BattlEye, then verify the game data through Steam and relaunch the game.
