When you're in the party chat you can't chat with people that are in game even though the icon shows up, you can hear them which makes me think that this is supposed to be a thing but I am unsure. I think it leaves you at a tactical disadvantage not being able to communicate with your squad in private without them hearing you.

If you switch to game chat before joining a server you can talk ingame, i have not tested further to see if you can then switch between party or not

As abject.sequence has mentioned, you can switch to the in game chat in party options. The party chat has priority over the in game chat, therefore the in game chat cannot be heard when you are in a party chat and have to switch it through the party options.
